Relationships : Current Laws: Resources by State/Jurisdiction

Today, all but a few states have enacted laws defining marriage as only between a man and a woman. Massachusetts is the only state that recognizes same-sex marriages, though a handful of states, including Vermont, Connecticut, New Hampshire, New Jersey, and Oregon, offer civil unions that are similar to marriage. California has a domestic partnership system that provides substantial protections.

Even if you are not from a state that recognizes same-sex relationships, you may want to travel to another state to get married or enter into a civil union. Couples do this to make their relationship “official,” even when they know it will not be recognized when they return home. However, bear in mind that your ability to get married may depend on your home state recognizing the marriage, as is the case in Massachusetts. Also, if you marry or enter into a civil union, it may be difficult to dissolve this relationship without living in the state that married you. You should think seriously about the implications of getting married or entering into a civil union if your home state will not recognize your relationship.

These pages provide information about legal systems of protections for same-sex couples, such as domestic partnerships, civil unions, and marriage. The landscape is changing rapidly, as courts and state legislatures begin to recognize the fundamental unfairness of treating gay and lesbian couples as legal strangers, so check back periodically for updates.
